Wrongful convictions don’t just happen—they result from structural failures. In the digital age, one of the most urgent and overlooked causes is the lack of technical capacity on the defense side. Misapplied digital forensics and unchallenged government evidence often stem from a deep knowledge and resource gap—especially in public defense and post-conviction work.
At Digital Innocence, we were founded to close that gap. What began as a focused effort to support defense teams in Connecticut has grown into a national mission: ensuring public defenders have the tools and support they need to deliver effective representation in the digital age.
The Problem: Misused Digital Evidence and Under-Resourced Defenders
Whether in trial, plea negotiations, or post-conviction review, digital evidence increasingly plays a decisive role. Yet public defenders are often left without the training, tools, or technical support to meaningfully challenge evidence collected by law enforcement—or to proactively uncover digital evidence that supports the defense.
The result?
- Weak or unchallenged forensic claims become central to the prosecution’s case
- Exculpatory digital records are overlooked or withheld
- Defendants are convicted based on misunderstood or overstated digital evidence
This isn’t just a disadvantage. It’s a pathway to injustice.
The Solution: Building Technical Capacity for the Defense
At Digital Innocence, we provide the technical knowledge and resources that public defenders and post-conviction teams need to engage effectively with digital evidence—and prevent wrongful convictions before they happen. Our strategy includes:
🧰 The Digital Evidence Toolbox
A comprehensive, open-access resource built specifically for public defenders. It includes:
- Data interpretation guides
- Best practices and industry standards
- ISO-aligned forensic quality system templates
- Sample motions and strategic checklists
- Technical primers and litigation support tools
This toolbox helps legal teams evaluate, challenge, and use digital forensic evidence with confidence.
🧭 Post-Conviction Digital Evidence Review Criteria
We developed the first national framework for evaluating digital evidence in closed cases—helping post-conviction teams identify when flawed forensics may have played a role in a wrongful conviction.
We work side-by-side with public defender agencies, appellate offices, and training organizations to build lasting capacity—both on individual cases and across entire systems.
From Connecticut to the Country: Scaling Our Impact
We’ve seen the model work in Connecticut:
- Exonerations based on accurate interpretation of phone records and cell site data
- Dismissals after exculpatory digital evidence was uncovered by the defense
- Empowered defenders able to challenge expert claims that previously went unopposed
But these challenges aren’t unique to one state. Across the country, defense teams face the same uphill battle—and their clients face the same risks.
That’s why we’re scaling our mission. By sharing our tools, training, and review frameworks nationwide, we aim to prevent wrongful convictions before they happen—and help build a more balanced, technically sound justice system.
